Terms of Use

Overview
These Terms of Use govern your use of the Ember app and website. By creating an account or using Ember, you agree to these terms and to our Privacy Policy. If you do not agree, please do not use Ember.
Not Medical Advice
Ember provides general nutrition and fitness information for educational and informational purposes only. Ember is not a medical device and does not provide medical advice, diagnosis, or treatment. Nutrition estimates, calorie and macro targets, workout suggestions, and AI coach responses are not a substitute for professional medical advice. Always consult a physician or qualified health provider before starting a diet or exercise program, especially if you have a medical condition, are pregnant, or take medication. Never disregard professional medical advice because of something you read in Ember.
AI-Generated Content
Ember's coach and food analysis features are powered by artificial intelligence. AI output can be inaccurate or incomplete — including calorie counts, portion estimates, and food identification from photos. Verify important information (such as allergen content) independently before relying on it. You can report a problematic AI response from within the app or by emailing us.
Who Can Use Ember
You must be at least 18 years old to use Ember. By using Ember, you represent that you meet this requirement. Ember is not directed at children, and we do not knowingly collect data from anyone under 18.
Your Account
You are responsible for the accuracy of the information you provide and for activity that happens under your account. You can delete your account at any time from inside the app; see the Privacy Policy for how deletion works.
Subscriptions and Billing
- Ember Pro is an auto-renewable subscription billed through your Apple ID. Prices are shown in the app before you subscribe.
- If a free trial is offered and you are eligible, the subscription converts to a paid subscription automatically when the trial ends unless you cancel at least 24 hours before.
- Subscriptions renew automatically at the end of each billing period until cancelled. You can cancel anytime in your device's Settings under your Apple ID subscriptions; cancellation takes effect at the end of the current period.
- Deleting your Ember account does not cancel your App Store subscription — manage or cancel it in your device Settings.
- Refunds are handled by Apple under the App Store's terms.
Acceptable Use
Don't misuse Ember. This includes attempting to access other users' data, reverse engineering the service, using Ember to generate harmful or unlawful content, interfering with the service's operation, or using automated means to access the service outside its intended interfaces.
Your Content
You own the content you create in Ember (food logs, photos, chat messages, workout data). You grant us the limited license needed to store, process, and display that content to operate the service — including processing by the AI service providers listed in our Privacy Policy. We do not use your content for advertising and do not sell it.
Disclaimers and Limitation of Liability
Ember is provided "as is" without warranties of any kind, express or implied, including fitness for a particular purpose and accuracy of nutrition data. To the maximum extent permitted by law, Bitcrush Labs will not be liable for indirect, incidental, special, or consequential damages arising from your use of Ember, and our total liability for any claim is limited to the amount you paid us in the twelve months before the claim arose.
Termination
You can stop using Ember at any time. We may suspend or terminate access for violations of these terms or to protect the service and its users.
Changes to These Terms
We may update these terms as Ember changes. When we do, we will update the effective date on this page. Continued use of Ember after changes take effect constitutes acceptance of the updated terms.
